Letter or agreement n023 - Regarding the creation of a provincial working committee to update the national provisions of the collective agreement following the creation of Santé Québec and the adoption of bill 15, an act to make the health and social services system more effective

CONSIDERING  the adoption of Bill 15, An Act to make the health and social services system more effective (hereafter “Bill 15”), on December 9, 2023;

CONSIDERING  the creation of Santé Québec;

CONSIDERING  the Act respecting bargaining units in the social affairs sector (U-0.1), and changes to come;

CONSIDERING  the Act respecting the process of negotiation of the collective agreements in the public and parapublic sectors (R-8.2);

The parties agree on the following.

Following the creation of Santé Québec and the adoption of Bill 15, within ninety (90) days after the date on which the collective agreement comes into force, the parties agree to set up a provincial working committee to examine the impact of these transformations on the national provisions of the collective agreement.

MANDATE

The committee has a mandate to:

  • analyze the possible impact on the provisions of the collective agreement;
  • submit its analyses and make recommendations to the negotiating parties no later than twelve (12) months before the collective agreement expires. The parties may agree to make recommendations to the negotiating parties throughout the period when the committee is doing its work.

COMPOSITION

The committee consists of four (4) representatives of the employer side and four (4) representatives of the union side.

Each party may call on one additional person with the agreement of the other party.
